$349.5k settlement is more than 8X the initial insurance company offer

ELIZABETHTOWN, KY, February 27, 2024 /24-7PressRelease/ — Hughes & Coleman Injury Lawyers has secured substantial compensation for a Kentucky woman who suffered severe injuries after a car wreck in Radcliff, KY, acquiring a $349,580.60 car accident settlement. This $349.5k settlement comes after an initial insurance company offer of only $40,000.

The injured victim was on her way home from a full day of work as a software engineer. As she went around a curve, she all of a sudden noticed another vehicle approaching hers from the opposite direction. The vehicle had crossed over the yellow line, into her lane, and with no time to react, struck her. The incident crushed her car resulting in her driver’s side door being jammed shut, forcing our client to climb across the inside of her vehicle to exit the passenger side door.

When EMS and law enforcement arrived at the scene, the client was found on the ground, outside of her vehicle. Although she was able to make her way out, her injuries were severe. She complained of pain covering almost the entire left side of her body, including her shoulder, arm, hand, and breast, as well as in her lower extremities (knee and leg) on her right side.

After arriving at the scene, EMS immediately transported her to Hardin Memorial Hospital, where she underwent diagnostic tests and received initial treatment for her injuries. It was quickly determined that she had suffered a nondisplaced fracture of the neck, a fracture in the fifth metacarpal of her left hand (close to the pinky), and a contusion to the left shoulder and chest. Although daunting, these initial diagnoses would be the least of her concern in her long path to recovery.

After initial treatment, during continued treatment, and once the adrenalin from the wreck wore off, the victim noticed a constant headache on the left side of her face, focused around her left eyebrow. She was also experiencing dizziness and immense pressure behind her eyes. After an appointment with an optometrist, she was diagnosed with a post-traumatic headache, told to take some time off work, and prescribed some pain medicine.

As time passed, her life was turning out to be more difficult than it was prior to the wreck. The injury to her head was causing a daily headache, which included difficulties with focus, memory, and movement, plus dizziness and information overload. Her job as a software engineer was almost impossible, as many of the day-to-day tasks she was having trouble with were skills she used as a coder.

The injuries from the wreck caused the client’s entire life to change. She had to switch jobs, not getting the same fulfillment from her new one as she did her prior employment. She was unable to partake in some of the activities her and her husband used to do for fun, such as riding motorcycles and doing charity work. Overall, the injuries sustained from the wreck changed her physically, mentally, and emotionally – they changed who she was as a whole.

A few days after the incident, she called Hughes & Coleman. When reviewing the insurance documentation, the team learned there were two separate policies available that they could potentially secure compensation for the client from – one was her own underinsured motorist coverage and one was the defendant’s liability coverage.

A demand was sent to the defendant’s insurance company for the entirety of the $50,000 limit, which was seamlessly agreed to. The client’s own insurance company, however, proved to be more difficult and tried to dismiss the claim entirely, which was unacceptable. At the beginning, they offered a measly $40,000, which was immediately declined as it was unjust and nowhere near the amount she deserved. Through further negotiations and demands, the insurance company finally offered a fair amount of $300,000, of which the client accepted.
